These Terms of Use (“Terms”) govern your access to and use of the Marine Passport website, products, services, vessel searches, reports, accounts, and related content (collectively, the “Services”) provided by Marine Passport LLC (“Marine Passport,” “we,” “us,” or “our”). By accessing or using the Services, or by purchasing a Marine Passport report or other paid Service, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use paid Marine Passport Services or create an account.

2. The Marine Passport Services

Marine Passport provides vessel information, research, history, records, and related services using information obtained from government agencies, public records, manufacturers, third-party data providers, and other available sources.

Depending on the Service and the vessel searched, information may include vessel identification, registration information, specifications, manufacturer and model information, historical records, reported damage, claims information, service or maintenance information, documents, reported incidents, and other available information.

The information and Services available for one vessel may differ substantially from those available for another vessel.

Marine Passport may add, remove, update, correct, or modify information, features, data sources, and Services as our products develop.

3. Information Sources, Accuracy, and Completeness

Marine Passport relies on information supplied by government agencies, public records, manufacturers, third-party providers, and other sources.

We do not guarantee that information provided through the Services is accurate, complete, current, or error-free. Information may be delayed, incomplete, outdated, unavailable, or incorrectly reported by its source.

Marine Passport does not have the complete history of every vessel. The absence of a reported event, record, damage, claim, registration, ownership change, service record, or other information should not be interpreted as evidence that the event or record did not occur. Marine Passport can only report information that is available to us from our sources.

Marine Passport does not independently verify every piece of information provided through the Services and does not guarantee that information from any particular source is accurate or complete.

4. HIN Searches and Customer Input

A Hull Identification Number (“HIN”) is required to search for a vessel through applicable Marine Passport Services.

You are responsible for entering the correct HIN. Marine Passport is not responsible for information returned from an incorrect HIN submitted by you.

You should review and confirm the HIN displayed before purchasing or accessing a paid report.

If a report is generated for the HIN you submitted, the report is considered delivered for purposes of the applicable purchase, regardless of whether you intended to search a different vessel.

If Marine Passport is unable to generate or deliver a purchased report because of a technical problem, we may restore the applicable report credit, provide access to the report when available, or issue a refund.

5. Reports and Report Credits

Certain Services require payment.

Marine Passport may offer individual reports and packages containing multiple report credits.

A report credit may be used to obtain an eligible vessel report as described at the time of purchase. A report credit is consumed when a report is generated or accessed.

Unless otherwise stated at the time of purchase, report credits expire 90 days after the date of purchase. Unused credits expire at the end of that period and are not refundable or transferable.

Purchased reports will remain available through your Marine Passport account for the period specified for the applicable Service.

If Marine Passport is unable to generate or deliver a purchased report because of a technical problem, we may restore the applicable report credit, provide access to the report when available, or issue a refund.

Marine Passport may modify or discontinue particular report products, packages, or features in the future.

6. Pricing and Payment

Prices and available products are displayed at the time of purchase.

Marine Passport may change pricing, packages, features, and availability from time to time. Changes will not affect purchases already completed unless otherwise permitted by law.

Payments may be processed through third-party payment providers. Marine Passport does not store your complete payment-card information.

You are responsible for applicable taxes and other charges associated with your purchase.

7. Refunds

Refunds may be requested within 30 days of purchase.

For multi-report packages, refunds are available only if none of the report credits in the package have been used.

Refund requests involving an individual report or a package for which one or more credits have been used may be reviewed on a case-by-case basis, including circumstances involving duplicate charges, technical problems, or other issues that prevented delivery of the purchased Service.

An approved refund may result in cancellation of the corresponding report access or unused report credits.

Marine Passport reserves the right to deny refund requests that do not meet the applicable refund requirements or that involve misuse of the Services.

8. Accounts

Certain Marine Passport Services may require you to create an account.

You agree to provide accurate information and to keep your account information current.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

You must notify Marine Passport promptly if you believe your account has been accessed without authorization.

You may not share your account credentials except as expressly permitted by Marine Passport.

9. Permitted Use and Restrictions

You may use the Services for lawful personal, informational, research, and purchasing purposes.

Unless Marine Passport expressly authorizes otherwise, you may not:

  • resell, redistribute, publish, sublicense, or commercially exploit Marine Passport reports or data;
  • systematically copy, scrape, harvest, download, or collect information from the Services;
  • use automated tools to access or retrieve substantial portions of the Services;
  • use Marine Passport information to create or supplement another database, directory, report service, or competing product;
  • circumvent security, usage limits, or other controls;
  • interfere with the operation or availability of the Services;
  • attempt to gain unauthorized access to accounts, systems, or data; or
  • use the Services for unlawful purposes.

Nothing in this section prevents you from using a purchased report for your own lawful vessel purchase, ownership, maintenance, research, or other personal purposes.

10. Personal and Professional Use

Marine Passport may offer products for both personal and professional users.

Reports purchased for personal use may not be resold or redistributed as a commercial service.

Marine Passport may offer separate packages or programs for brokers, dealers, insurers, lenders, surveyors, and other professional users. Additional terms may apply to those Services.

11. Third-Party Data and Services

Marine Passport may rely on government agencies, public records, manufacturers, commercial data providers, public databases, and other external sources.

Marine Passport does not control those sources and cannot guarantee their availability, accuracy, completeness, or timeliness.

A third-party source may modify, restrict, remove, delay, or discontinue information without notice.

12. Events Beyond Our Control

Marine Passport is not responsible for delays, interruptions, or failures caused by circumstances beyond our reasonable control, including interruptions or failures affecting third-party data sources, hosting providers, payment providers, telecommunications networks, or other services on which Marine Passport relies.‍

13. Professional Evaluation

Marine Passport is an information and research service. It is not a marine surveyor, mechanic, appraiser, insurer, attorney, lender, or other professional advisor.

Marine Passport is not a substitute for a professional marine survey, mechanical inspection, sea trial, or other appropriate evaluation of a vessel. You should independently evaluate any vessel before purchasing or otherwise relying on information about it.‍

14. Intellectual Property

The Marine Passport website, software, design, branding, reports, text, graphics, data compilations, and other original content are owned by Marine Passport or its licensors and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, purchasing a report or other Service does not transfer ownership of Marine Passport's technology, data compilation, report format, or other intellectual property.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INFORMATION PROVIDED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

MARINE PASSPORT DISCLAIMS WARRANTIES RELATING TO ACCURACY, COMPLETENESS, CURRENTNESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MARINE PASSPORT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT A SEARCH OR REPORT WILL PRODUCE ANY PARTICULAR TYPE OR AMOUNT OF INFORMATION.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MARINE PASSPORT AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, MARINE PASSPORT'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PAID SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Marine Passport and its members, managers, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of:

  • your unlawful use of the Services;
  • your violation of these Terms; or
  • your infringement or violation of another person's rights.

18. Suspension and Termination

Marine Passport may suspend or terminate your access to the Services or your account if we reasonably believe that you have violated these Terms, applicable law, or the rights of others.

Marine Passport may also modify, suspend, or discontinue any portion of the Services.

Sections that by their nature should survive termination—including provisions concerning intellectual property, permitted use, disclaimers, limitation of liability, indemnification, and governing law—will survive termination.

19. Privacy

Our collection, use, and disclosure of personal information is described in our Privacy Policy.

20. Changes to These Terms

Marine Passport may revise these Terms from time to time. Updated Terms will be posted on this page with a new Effective Date.

Your continued use of the Services after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

21. Governing Law; Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.

Subject to applicable law, any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction and venue.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
